The general terms and conditions of the online store viktoria-cosmetic.com have been drawn up in accordance with the Consumer Protection Act (ZVPot) with the recommendations made by the Slovenian Chamber of Commerce and Industry (GZS) and the international e-commerce codes. The online store viktoria-cosmetic.com is an informational system dedicated to presenting and selling products to the user. It is managed by the company Phoebus d.o.o, later referred to as the tenderer. The user is a person, who uses our system; ergo the customer of our store. When they register in the online store, the visitor receives a username, which matches the e-mail they used, and a password. The username and password unambiguously define and connect the user and their information. After registering, the visitor becomes a user and gains the right to purchase. General terms and conditions regard the operation of the online store viktoria-cosmetic.com, the user’s rights, and the professional relationship between the tenderer and consumer.

 

 

Access to Information

 

The tenderer commits to always provide the consumer with the following information: the company’s identity, contact information, basic characteristics of the goods or services, accessibility to the products, shipping or executive conditions, clearly specified prices, payment and delivery methods, the offer validity period, a time limit within which it is possible to withdraw from the agreement and the conditions for withdrawal and the explained complaint procedure including all customer service contact details.

 

 

Payment Methods


The online store viktoria-cosmetic.com provides the following payment methods:

  • proforma invoice
  • payment upon delivery via the Post of Slovenia
  • credit card payment (Visa, Mastercard, Diners)

 

The tenderer issues a standing order bill to the customer, which includes the breakdown of expenses and instructions on how to cancel an order and return the products if need be. A purchase and sale agreement (order) is electronically saved in the tenderer’s server and always available to the consumer on their profile. 
 

 

Offer Validity

The prices stated in the online store are irrevocable and are valid only for online orders. Prices may vary between the online store and in-person stores across Slovenia. The prices apply in conjunction with the payment methods and terms and conditions mentioned above. All prices are subjected to VAT unless stated otherwise. Despite exceptional efforts to provide precise and up-to-date information, some pricing errors may occur. In such case, or if there is a price change while the order is being processed, the consumer will be able to withdraw from the purchase. Meanwhile, the tenderer will set up a mutually beneficial solution to the satisfaction of both the consumer and the tenderer. If the product is out of stock, a change in price may occur. In such case, the tenderer informs the consumer of the change. The images are informative and do not always reflect the entire situation.

 

 

Discount Validity

The discount deadlines are cited next to the discounted offer and may vary from offer to offer. Various discounts cannot be added up.

 

Process of Purchase:

 

  1. The order is received: After completing the purchase, the customer will receive an order confirmation e-mail. The customer has one hour to cancel the order. Extensive information about the status and contents of the order is always available to the customer on the tenderer’s website.
  2. Order confirmation: If the customer does not cancel the order, the order is processed. When the tenderer goes over the order, they check the ordered article’s availability and confirms or declines the order. In order to confirm the accuracy of the information or guarantee accurate delivery, the tenderer may contact the customer by calling the number provided upon registration. When supplying products out of stock in the tenderer’s own warehouse, the tenderer is tied to the delivery and delivery time of their supplier. The tenderer promptly informs the customer about data concerning the delivery of the goods. If the delivery period is very long and the customer refuses to wait, the product will be removed from the purchase and the customer will be compensated for the paid items. Other articles will be, by the customer’s wishes, delivered or the entire order will be cancelled. The tenderer is not liable for any damages caused by longer delivery deadlines or non-delivery of goods not in stock in the tenderer’s warehouse.
  3. Goods dispatch: The goods shall be prepared and dispatched by the tenderer within the given deadline. The consumer will be notified of the dispatch via email. Information about returns, delays, or complaints will be enclosed in the said e-mail.

  

 

Discount Codes
A discount code or a promo code is used to provide various benefits to an online order in the online store viktoria-cosmetic.com An active code can be found on the cover of the advertisement, our e-mail, or other media. The code brings various benefits such as gifts, discounts, etc. Every code has a time limit and must be used within that period. After the deadline, the code will be invalid. A discount code can be applied to all products or just one specific product.

How a discount code is used:

• Choose the products you wish to purchase and add them to the cart.

• If the code applies to only one product, choose that one.

• Above the information and delivery forms, there is a slot “Enter a discount code or a voucher code”. Write in the discount code and click “use code”.

• Only one code can be used per purchase.

• When the discount code is added, the value of the discount will be automatically added. What remains is the amount that needs to be paid.

 

Order Cancellation, Return of Goods

 

The consumer has the right to contact the company by e-mail (info@phoebus.si) and cancel their agreement within 14 days. After contacting the company, the consumer has 14 days to return the products. The consumer covers the costs of return delivery. Deliveries sent with payment upon delivery will be rejected.

Products must be unused and undamaged, must come with the original packaging, and must not differ in quantity. Before deciding to withdraw from the agreement, the customer must check and evaluate the product to the extent necessary to access the actual condition. The customer must not continue using the product until exiting the agreement. Treating products differently than just mentioned counts as using the product and will result in us rejecting the customer’s request to leave the agreement and sending the product back, per the customer’s expense.

The product should be sent to Phoebus d.o.o., Hubadova 8, 1000 Ljubljana.

When returning the product, the customer must enclose the cancellation form. The tenderer refunds the entire purchase price (including delivery costs) as soon as possible, or at the latest 14 days after receiving the message or the products. Legal persons do not have the option to leave the agreement in the same way as consumers (natural persons).

 

 

Warranty

Warranty for the products featured in the online store is in line with the Slovenian legislation.

 

 

Delivery times

Delivery time is measured in the number of workdays - generally 5 days from the order placement. It usually takes 1-2 days.

 

Delivery
The tenderer must deliver their goods on time. The online store ships using The Post of Slovenia. The cost of delivery for purchases under 40.00€ is 4.00€. Shipping is free for purchases over 40.00€.

Important: for payment-upon-delivery shipments, an added cost is included by The Post of Slovenia:

  • for purchases under 98€, the added cost to the Post of Slovenia is 1.05 €
  • for purchases from 98€ to 501€, the added cost to the Post of Slovenia is 1.07% of the sum
  • for purchases above 501€, the added cost to the Post of Slovenia is 5.36€.

 

Security
The tenderer uses appropriate technological and organisational means for the protection of transferring and saving personal information, orders, and payments.

 

Privacy Policy
The tenderer is bound to maintain permanent security of all personal data in line with the Law on Personal Data Protection (Ur. list RS št. 86/2004) and the Insurance Act. All data acquired through the website viktoria-cosmetic.si will be used exclusively for sending informative texts, offers, receipts, and other necessary communication.

 

Communication. Advertising emails must be clearly and unambiguously marked as such. The sender must be clearly stated. If the user wishes not to receive promotional emails, the tenderer will abide by their wishes.

 

Absolution of Responsibility: The tenderer tries, to their best ability, to provide accurate and current information, published on their website. However, information such as pricing and availability is subject to rapid changes and might sometimes not be updated in time. In that case, the tenderer will notify the buyer and enable them to cancel or swap out the ordered item. All photographs are used for illustration purposes and do not reflect the properties of the product. We are not liable for any typos that might occur.

 

Complaints and Disputes: The tenderer respects the Consumer Protection Act. Complaints can be submitted by email to info@phoebus.si or by mail to the address: Hubadova 8, 1000 Ljubljana. The tenderer must confirm that they have received the complaint in 5 days and must notify the user of how long the process will take and keep them updated throughout. The tenderer tries to their best abilities to resolve the conflict to the satisfaction of both parties.

 

The Receipt: Phoebus d.o.o. encloses the receipt at delivery. The price and all other expenses regarding the purchase are stated separately on the receipt. The buyer is responsible for verifying the validity of the information during the purchase. After the purchase, any objections regarding the correctness of the receipt are not accepted.

 

Out-of-court Settlement of Consumer Disputes: In accordance with the legal norms, Phoebus, d.o.o. does not recognize any performer of out-of-court settlement of consumer disputes as responsible for resolving a consumer dispute that the consumer could launch in accordance with the Out-of-Court Consumer Dispute Resolution Act.

As an online seller of goods and services in the Republic of Slovenia, the company Phoebus d.o.o. offers an electronic link to the online dispute resolution platform for consumers (ODRP) on their website. The platform is available at ec.europa.eu/odr.


The above regulation follows from the Out-of-Court Consumer Dispute Resolution Act, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and the amendment Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
